USER TERMS OF SERVICE & MARKETPLACE AGREEMENT FOR QUEUER

1. LEGAL BINDING CONTRACT & ACCEPTANCE
1.1 Contractual Relationship: This Terms of Service ("Agreement") constitutes an agreement between Padmasree Infocom ("Company", "we", "us", "our") and any individual ("User", "you", "Sender", or "Receiver") accessing or using the Queuer application and associated services.
1.2 Express Consent: By tapping "I Agree", registering an account, or using the Platform, you acknowledge that you have read and agreed to this Agreement.
1.3 Updates: Updated terms may be posted from time to time. Where required, renewed affirmative consent may be requested.
2. NATURE OF SERVICE & THIRD-PARTY VENUES
2.1 Queuer is a digital marketplace enabling users seeking physical line-standing assistance ("Senders") to connect with users willing to perform queue-assistance tasks ("Receivers").
2.2 Nothing in these Terms by itself determines employment, agency, partnership or tax status; those questions depend on applicable law and the real relationship between the parties.
2.3 Padmasree Infocom is not affiliated with, endorsed by, or partnered with third-party venues unless expressly stated.
2.4 Queuer does not sell official tickets, government tokens, priority passes, or appointments. Users must comply with venue rules. Queuer does not guarantee that a venue permits proxy queuing or spot-swapping.
3. ACCOUNT REGISTRATION, IDENTITY & FRAUD PREVENTION
3.1 Users must be at least 18 years old.
3.2 One verified account may be used in both Sender and Receiver modes.
3.3 Users must provide accurate information. Receiver KYC, PAN, bank details and government-ID verification may be required before real-money withdrawals when enabled.
3.4 Fraudulent, fake, impersonated, shared or manipulated accounts may be suspended.
4. FINANCIAL FLOWS, FEES, AND PAYMENT FACILITATION
4.1 Fee Structure:
• Underlying Expense Reimbursement: pre-approved third-party expenses where applicable.
• Fulfillment Charge (5%): amount associated with Receiver fulfillment under the current Queuer model.
• Platform Convenience Fee (2%): platform usage fee charged by Padmasree Infocom.
4.2 Padmasree Infocom is not represented as a bank or legal escrow agent. Payment collection and settlement for live operations must occur through the applicable regulated payment provider and its approved product configuration.
4.3 In the current software flow, Receiver eligibility is conditional on completion and Sender confirmation or another approved completion rule.
4.4 Taxes/TDS will be handled in accordance with applicable law and the actual tax status of the parties.
4.5 Users must not circumvent the Platform to avoid platform fees after being introduced through Queuer.
5. TASK LIFE-CYCLE, CANCELLATION, AND REFUNDS
Current product rules displayed by the app control the amount shown before confirmation. The prototype presently uses:
• Before Receiver acceptance: Sender cancellation — full refund.
• After acceptance / arrival, where supported by the app: a cancellation charge may apply, including Receiver compensation.
• Receiver cancellation before completion: Sender receives the applicable refund and Receiver forfeits task earnings.
• Fraud, non-arrival, forged proof or abandonment may cause forfeiture, strikes, suspension and investigation.
6. GEOLOCATION AND PHOTO-PROOF REQUIREMENTS
6.1 Active tasks may require GPS/location permissions. Spoofing or falsifying location data is prohibited.
6.2 Sender task photos and Receiver proof photos must be relevant, authentic and unaltered.
6.3 Proof content is intended to be restricted to the relevant Sender, assigned Receiver, and authorized Queuer administrators for fulfillment, fraud detection and dispute handling.
7. USER CONDUCT & PROHIBITED ACTIVITIES
Users must not create illegal tasks, procure prohibited goods, harass or threaten others, falsify proofs, manipulate ratings, launder funds, attack the Platform, scrape protected data, gain unauthorized access, or misuse payment/refund systems.
8. LIABILITY
Nothing in these Terms excludes rights or liabilities that cannot legally be excluded under applicable Indian law. Queuer is not responsible for venue decisions, third-party conduct, or losses caused by a user's own violation of law or venue rules, subject to mandatory consumer rights.
9. TERMINATION & SUSPENSION
Accounts may be limited, suspended or terminated for fraud, safety risk, material breach, legal requirements or misuse. Legitimately payable balances will be handled according to applicable law and payment-provider rules.
10. GOVERNING LAW & DISPUTES
These Terms are governed by Indian law. Dispute resolution, arbitration and court jurisdiction will be applied only to the extent enforceable under applicable law. The intended operational jurisdiction is Tamil Nadu, India.
